The Manafort conviction, of a sundry eight counts of tax evasion and bank fraud, seems like a big deal because there was so much fanfare, because the judge made a fool of himself a number of times, and because the jury took a while to decide. But the bigger event today was probably Cohen’s guilty plea to charges of tax evasion and election violations. That took much less time, no trial, presumably a bargain struck.

Here’s the important part: Michael Cohen, Donald Trump’s fixer and wise guy, pled guilty to paying off two women to keep them silent about affairs they had had with Trump, in coordination with Trump. Cohen explicitly said that he participated in this silencing arrangement “for the principal purpose of influencing the election.” So there you go.

Cohen will probably spend 3 years or so in the stir for that set of guilty pleas (which also involved tax fraud). It remains to be seen how much the former candidate, who apparently colluded, to use a certain term, with Cohen in that matter, will spend in prison. Keep in mind, of course, that the federal election law violation may be only a small part of Cohen’s likely multi-year conviction.

Tomorrow morning is a morning you may want to saunter down to the local news stand and pick up a copy of any respectable national newspaper. The front page is going to have an interesting set of headlines on it, I’ll wager.

  1. They tried to go after John Edwards by turning a sex scandal into a campaign finance violation. Result was a hung jury and eventual dropping of charges, and that was after needing the argument that it was campaign related because of Edwards’s reputation as a family man.

    Michael Cohen’s plea where they had him dead to rights on tax evasion doesn’t change that.

    Now a former head of the FEC Bradley Smith has given a detailed explanation of why this isn’t a campaign finance violation.

    the Persecutor loads the defended up with multi-charges. Then during
    negotiations, they will offer to drop some, if the defendant pleas
    guilty to others. Conviction – with no expensive trial.

    The Bradley Smith statement is from March and predates Cohen’s confession. Using it in the current situation is disingenuous.

      The donors in the Edwards case were declared by FEC as not having committed a campaign finance violation, and if Cohen wasn’t staring at 50 years in prison for tax evasion, he would have fought the campaign finance violation charges and won. The other charge is also questionable. By this logic Avenatti could be charged for the Anderson Cooper interview of Stormy Daniels.

    No. Uninvolved observers don’t know what evidence the raids got , but Cohen does. There is, of course, the possibility that Cohen is confessing to something he knows the prosecutors already know. This is fairly standard procedure. As BBD wrote, there’s other corroborating evidence, and this would also include statements by Giuliani and the released tape. The idea that Cohen’s payment of hush money at that particular time wasn’t made to influence the election is absurd.

  11. So, MikeN has given up attempts to equate Edwards and Trump. He has no evidence that Cohen dishonestly implicated Trump. His claim, “without this statement from Cohen there is no campaign finance violation,” is only meaningful if one is prepared to ignore all of the other evidence, including the fact that Trump has retreated from his original denials and changed his story several times. Proof doesn’t have to consist of one conclusive piece of evidence, but can also be various pieces of evidence that fit together and form a cogent whole. In this case it seems that prosecutors have both.

    I made a mistake regarding the jurisdiction of this specific Cohen case, but the bigger picture is that Trump could be prosecuted at the state level, so his pardon power has limited value. This and other problems related to a presidential pardon are described in this article:

    And one more thing: I didn’t mention that handing the case over to prosecutors in New York was a way of avoiding political attacks on the Mueller investigation. In light of the obsequiousness and contortional dishonesty of Trump’s supporters, this is an unfortunate but necessary consideration.

This is especially delectable because Trump’s most notable mentor was Roy Cohn, who as a young lawyer was McCarthy’s henchman and whose later clients included prominent mobsters.

    A reasonable point about wanting to avoid the attacks on Mueller, but in that case Manafort should have been handed off too. It is possible his links with all these intelligence types would fit into the Russian interference in elections.

This, I believe is the end you want – not justice, but a subversion of justice that protects Trump. Because of the perverse state of American politics Mueller has to both prove the validity of the investigation, which he’s done by getting a jury to convict Manafort, and make sure that a political decision to end the Mueller Investigation doesn’t end the investigative process. The threat against the investigation appears to be growing because it’s gotten results and now constitutes a threat to Republican positions of power.     He is wanted in the US on what appear to be trumped up charges, but I am not familiar with how much the US cares about bribery by foreigners in other countries, as Firtash is accused. Spain also wants him for extradition.

    Lanny Davis is working for Michael Cohen pro bono. Thus a zealous prosecutor could argue that pro-Russian oligarch Dmytro Firtash is paying for Michael Cohen’s legal defense. Since Trump has filed papers for 2020, this would constitute paying money to influence a federal election by pro-Russian oligarch Dmytro Firtash.

    Lanny Davis probably hasn’t committed crimes for which he would serve decades in prison. But let’s say prosecutors have him followed, and he is caught on a trip from meeting with Michael Cohen in New York to a trip in DC to talk with officials about pro-Russian oligarch Dmytro Firtash going 76 on I-95. This carries a maximum sentence of one year in jail. Prosecutors could then charge Davis with this and whatever else they have on him, and then reach a plea where Lanny confesses to campaign finance violations, specifically assisting pro-Russian oligarch Dmytro Firtash in the influencing of a federal election.
    The charge itself is ridiculous, but the prosecutor would then have additional charges to place against Firtash and a stronger case for a successful extradition.
