Mueller and his Grand Jury are likely to drop a shoe or two next week

About two fortnights ago, almost all evidence of the Mueller investigation’s progress stopped. This was expected, as it is a Justice Department rule to not do things, like issuing indictments, from several weeks prior to an election, until after the election.

Coincidentally (?), yesterday, a document was released to the public that dates back to the days of Watergate. This document is, in essence, an indictment issued by the Watergate grand jury, bring charges against Nixon. However, since the policy was to not actually indict a sitting president, this special indictment was given, not to a federal prosecutor, but to the US House judiciary.

So, there are two things floating around in my head that I’m wondering about.

First, and most obvious, is this: Will next Wednesday, or at least, the latter half of next week and perhaps a day or two into the next work week, see a series of actions from Mueller? And if so, what?

Second, and less obvious, is this: The document that was released yesterday isn’t just a grand jury document, but also, the decision by a federal judge that this grand jury indictment-thingie should properly be passed to the house, secretly, just as a normal indictment would be passed to a federal prosecutor, secretly. The secrecy part is just because all grand jury proceedings are secret. It is then up to the prosecuting body to make things public by carrying out actual indictments and prosecutions, or in the case of the house, impeachment.

The point is, it is now federal case law that a Grand Jury investigating a president can hand over what would normally be an indictment to pass on to a federal prosecutor to the House Judiciary Committee, for their consideration. It is secret when that happens, and if the committee decides, it can remain secret.

So, is it possible that the Mueller grand jury has already written one of these embryonic indictments, and is planning to hand it over after the election? Or after the new House is sworn in? Depending on how the election goes????

Is it possible, in fact, that such a document has already been handed over, and is being ignored by the Republican leadership in the House? If so, will it be resubmitted to the new Congress later?

I suggested several weeks ago that there would not be any action until after the election. Now, I’m noting that the election is about to happen, so we can expect … something.

I’ve been cautious about predicting what Trump will do next, and when I do predict I’m usually wrong, because he is so random. But right now I’ve got a strong feeling that he is about to make a move on Mueller.

I know, I know, it’s been looking that way all along so saying that now is meaningless. But not really, because now is now and before was then. I know I know, he can’t do it because the law says he can’t. Well, wrong. That has never been true. I know, I know, it will be like the Saturday Night Massacre all over again. But no, that play has been made by Trump and it failed. Nixon had the balls to make the SNM work, and when Trump did the same thing he got told to sit down because he is basically a bully, and thus, spineless. So, he’ll be doing it a different way. ‘Twas the Night before Indictment …

‘Twas the night before serving, when all thro’ the house
Congresscritters were stirring, even the mouse;
The indictments were hung by the Grand Jury with care,
In hopes that Judge Emmet soon would be there;
The children were nestled all snug with their lawyers,
While visions of men named sugar plum danced in their heads.
And Mueller with his briefing and Paul with his passport,
Had just settled their brains for a long winter in court
When out on the lawn there arose such a clatter,
He sprang form the bed to see the Federal Marshals
Away to the window he flew like a flash,
Tore up the papers, then into the shredder,
The moon on the breast of the new fallen snow,,
Gave lustre to the no knock warrents to find objects below;
When, what to wondering eyes should appear,
But a deposit slip from a Russian owned bank forgotten to burn.
With that ol’ driver as quick as a feather;
We knew in a moment it much be St. Mueller;
More rapid than eagles his coursers they came,
And he whistled and shouted and called them by name:
Now, evidence collection crew, go right in here!
On blue collar crime expert, these documents I’ll share!
To the top of the pile of evidence so high,
Now dash away, dash away, put it all in plastic bags,
As dry leaves before the wild hurricane fly,
Each exhibit gets a number and a letter, oh my.
So up to the court house the coursers they flew,
With the sleigh full of evidence, and some indictees too.
And then in a twinkling, I heard in the foyer
The prancing and pawing of each little lawyer;
As I drew in my head, and was turning around,
Down the chimney St. Mueller came with a bound.
He was dressed all in a nice Italian suit,
His clothes were not tarnished or messed up with soot.
A bundle of evidence was flung on his back,
And he looked like a lion just opening a buck;
His eyes, how they twinkled, his dimples how merry,
His cheeks were like roses, he’d be liked by a jury.
His stern little mouth was drawn up like a bow,
But the kind with an arrow, just so you know;
He shook when he laughed like a bowl full of jelly;
With a wink and a twist he owned that grand jury;
He spoke not a word but went straight to work,
Filed all the briefings, then turned with a jerk,
And laying his finger aside of his nose
And giving a nod, up to chambers he rose,
He sprung to the sleigh to his team gave a whistle,
And to the judge they all rushed, like the smoke from a pistol;
I heard him exclaim, ere he drove out of sight,
“Plea bargains for all, except, well, most of you actually, because I’ve got this sack of evidence here, see?
