Americans United for Separation of Church and State says it will sue the Tuscumbia City School District if the song Silent Night is sung during a Christmas Program.

According to Tuscumbia City School Superintendent, Dr. Joe Walters, they have been advised by their attorney that the use of traditional Christmas music, including carols such as “Silent Night,” in the context of a school Christmas program has been permitted and ruled not to be in violation of the Establishment Clause of the U.S. Constitution.

Walters feels the Christmas program includes a variety of well known Christmas songs that advance the students’ knowledge of cultural and religious heritage.

  1. I am as about as militant an atheist as they come. I think lawsuits like this do more harm than good. Let them sing their songs.

The victory in this war is in the voices of popular culture which shapes the hearts and minds of the people. No court can do much to help with that and I think lawsuits like this do us harm.

  2. This is silly. AU needs to learn to pick its battles. I would file “Silent Night” or “Joy to the World” or any other number of Christmas Carols under traditional music, and let it be sung in that context.

  3. “Silent Night” is traditional music. I would sue if they sang “SilverBells” or “Little Drummer Boy”. I hate those songs.
